Terms of Service

By accessing or using the Cuento expense tracking service ("Service") operated by Dealer Software Solutions, LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

The Service is provided to businesses and their authorized employees for expense tracking and management purposes.

Cuento provides an expense tracking and management platform that allows employees to:

• Submit expense receipts via SMS/MMS text messaging
• Submit expense receipts via email
• Categorize and manage business expenses
• Export expense data for accounting purposes

The Service uses artificial intelligence to extract data from receipt images and may communicate with users via automated text messages.

By providing your mobile phone number and using the Cuento SMS service, you expressly consent to receive automated text messages from Cuento at the phone number you provide. These messages are related to expense submission and account notifications.

Consent and Opt-In

When you first text the Cuento service number, you will receive a consent request. By replying "YES" or "START" to this message, you confirm that:

• You consent to receive automated SMS/MMS messages from Cuento
• You are the owner or authorized user of the mobile phone number provided
• You understand that message and data rates may apply
• You can opt out at any time by replying STOP

Message Frequency

Message frequency varies based on your expense submissions. You will typically receive messages when:

• You submit a receipt and we confirm receipt
• We need additional information about an expense
• An expense status changes

Opting Out

You may opt out of SMS messages at any time by texting STOP to our service number. After opting out, you will receive one final confirmation message. You will no longer be able to submit expenses via SMS until you opt back in by texting START.

Supported Carriers

The Service supports major US carriers including AT&T, Verizon, T-Mobile, Sprint, and most regional carriers. Carrier message and data rates may apply.

You agree to:

• Provide accurate and complete information
• Submit only legitimate business expenses
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Comply with all applicable laws and regulations
• Not use the Service for any fraudulent or illegal purposes

You may not use the Service to:

• Submit false or fraudulent expense claims
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without permission
• Transmit any malicious code or harmful content

The Service and its original content, features, and functionality are owned by Dealer Software Solutions, LLC and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any expense data and receipt images you submit through the Service. By submitting content, you grant us a license to process, store, and transmit that content as necessary to provide the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Expense data submitted through the Service is shared with your employer's authorized administrators for review and approval purposes.

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

WE DO NOT GUARANTEE THE ACCURACY OF AI-EXTRACTED RECEIPT DATA. USERS ARE RESPONSIBLE FOR VERIFYING THE ACCURACY OF EXPENSE INFORMATION BEFORE APPROVAL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEALER SOFTWARE SOLUTIONS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOUR EMPLOYER FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Dealer Software Solutions, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
